These Terms of Service ("Terms") form a binding contract between you and The Global Conservatory ("TGC", "we", "us", "our"), an online conservatory delivering private lessons, group classes, masterclasses, and certificate and degree-track programmes. By creating an account, enrolling in a lesson or programme, applying as faculty, or otherwise using theglobalconservatory.com and our related platforms (the "Services"), you accept these Terms.
If you are under 18, you may use the Services only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your conduct.
1. About TGC
TGC is an independent online conservatory. We provide instruction, evaluation, and educational programming. We are not an employment agency, and we do not certify, license, or endorse any third-party teacher operating outside our platform. Faculty members are independent professionals engaged through TGC's contractual framework.
2. Eligibility & Account
- You must provide accurate and complete information when registering and keep it current.
- You are responsible for all activity under your account and for safeguarding your password.
- One person, one account. Sharing accounts (including parent–child sharing of separate enrolments) is not permitted.
- You may not create an account using another person's identity or impersonate any individual or institution.
- We may refuse, suspend, or close any account at our discretion where these Terms are breached, where there is a credible safeguarding or fraud concern, or where required by law.
3. Lessons, Programmes, and Bookings
- Booking: Lessons and programmes are confirmed only after payment is received and the booking is acknowledged in writing through the Services.
- Scheduling: All times are displayed in the time zone of your account profile. You are responsible for keeping your time zone accurate.
- Attendance: Students must join the lesson on time. If a student is more than 10 minutes late, the faculty member is not obligated to wait, and the lesson may be treated as a no-show under Section 8.
- Faculty assignment: We reserve the right to substitute faculty in the event of illness, emergency, or operational necessity. We will use reasonable efforts to provide a faculty member of equivalent qualification.
- Programme materials: Some programmes include downloadable scores, recordings, or written materials provided under a limited, non-transferable, personal-use licence (Section 7).
4. Payments
- All fees are listed in the currency shown at checkout and are inclusive of taxes only where indicated.
- Payments are processed by our payment processors (Shopify Payments, Stripe). By submitting payment, you authorise the charge for the booked lesson, package, or programme.
- Subscription and instalment plans renew automatically until cancelled in your account dashboard or in writing to info@theglobalconservatory.com.
- Failed or chargeback payments may result in suspension of access until the balance is resolved. We reserve the right to recover reasonable collection costs.
- Promotional codes and scholarships are subject to their own conditions and cannot be combined unless expressly stated.
5. Cancellations, Refunds, and Rescheduling
Cancellations and refunds are governed by our Refund & Cancellation Policy, which is incorporated into these Terms by reference. In the event of any conflict between these Terms and the Refund & Cancellation Policy, the Refund & Cancellation Policy controls for refund matters.
6. Lesson Conduct & Safeguarding
The Services are designed to be a safe and constructive learning environment. Both students and faculty agree to the following standards.
- Respectful conduct: No harassment, discrimination, intimidation, or sexual content. No language or behaviour that would be inappropriate in a professional teaching environment.
- Lesson environment: Lessons must take place in an appropriate, safe environment with adequate lighting and minimal distraction. For minors, a parent or guardian must be in the home and reasonably available throughout the lesson.
- Off-platform contact prohibited: Faculty and students may not exchange personal contact information (phone numbers, personal email, social media, messaging apps) or arrange lessons, performances, or services off the TGC platform. This protects students, faculty, and the integrity of safeguarding records.
- Recordings: Lessons may be recorded for quality assurance, faculty review, archive access, and educational improvement, as described in our Privacy Policy. Both parties are notified at the start of each session and may decline. Recordings may not be redistributed by either party.
- Substance use: Faculty and students must not appear in any lesson under the influence of alcohol or unprescribed substances.
- Reporting: Any safeguarding concern must be reported immediately to info@theglobalconservatory.com. We co-operate with relevant authorities in any credible report.
Breach of these standards is a material breach of these Terms and may result in immediate suspension or termination without refund.
7. Intellectual Property
7.1 TGC Property
All content on the Services not contributed by users — including the TGC name, logo, course design, written curriculum, video introductions, marketing copy, and the look and feel of the platform — is owned by TGC or its licensors and is protected by copyright, trademark, and other laws. You receive no rights in TGC property except as expressly stated.
7.2 Faculty Teaching Materials
Faculty members retain copyright in their original teaching materials, scores, and method documents. By providing these to TGC for use within a lesson or programme, faculty grant TGC a worldwide, royalty-free, non-exclusive licence to host, transmit, and present the materials within the Services for the duration of their engagement and a reasonable archival period.
7.3 Student Work
You retain copyright in your own performances, compositions, and recordings that you create. By submitting student work to TGC for evaluation or showcase, you grant TGC a non-exclusive, royalty-free licence to store the work, present it to your assigned faculty and reviewers, and — only with your separate written consent — to feature it in TGC's marketing or alumni programming.
7.4 Lesson Recordings
Audio and video recordings of lessons are joint works for the purposes of these Terms. TGC holds the operational copy for review and archive; the participating student (or, for a minor, the parent on file) holds personal-use access. Faculty may not redistribute recordings outside the lesson. Students may not publish or distribute recordings publicly without TGC's written consent.
7.5 Limited Personal Licence to Programme Materials
For materials provided as part of a paid programme, TGC grants you a limited, non-exclusive, non-transferable licence to download and use the materials for your personal study only, while your enrolment is active. You may not copy, redistribute, resell, post on file-sharing platforms, or use the materials to train any model.
8. Acceptable Use
You agree not to:
- Use the Services in violation of any law, regulation, or third-party right.
- Attempt to access another user's account or data, scrape, reverse-engineer, or interfere with the Services.
- Upload viruses, malware, or content that infringes copyright, trademark, or right of publicity.
- Solicit students, parents, or faculty for off-platform engagements.
- Post defamatory, harassing, or sexually explicit content in any TGC channel, including chat, comments, and student forums.
- Misrepresent your identity, credentials, or relationship to TGC.
Violation may result in immediate suspension or termination, removal of content, forfeiture of fees paid, and referral to the relevant authorities.
9. Suspension & Termination
- You may close your account at any time from your dashboard or by contacting us. Closure does not entitle you to a refund except as set out in the Refund & Cancellation Policy.
- We may suspend or terminate your account, with or without notice, where you breach these Terms, where required by law, or where there is a safeguarding or security concern.
- Sections that by their nature should survive termination — including Sections 7 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), 13 (Dispute Resolution), and 14 (Governing Law) — survive termination.
10. Disclaimers
The Services are provided "as is" and "as available". To the maximum extent permitted by law, TGC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that any specific musical or career outcome will result from your participation. Educational outcomes depend on the student's effort, prior preparation, and circumstances outside our control.
11. Limitation of Liability
To the maximum extent permitted by law:
- TGC, its faculty, staff, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost opportunities, or loss of data.
- TGC's total aggregate liability for any claim arising out of or relating to these Terms or the Services is limited to the greater of (i) the amount you paid TGC for the Services in the twelve (12) months preceding the event giving rise to the claim, or (ii) USD $200.
- Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless TGC, its faculty, staff, and affiliates from and against any claim, demand, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of the Services; (c) content you submit; (d) your violation of any law or third-party right; or (e) any conduct of a minor for whom you are responsible.
13. Dispute Resolution & Mandatory Arbitration
Please read this section carefully. It affects your legal rights, including your right to bring a court action.
- Informal resolution first: Before filing any claim, you agree to contact us at info@theglobalconservatory.com and attempt to resolve the matter informally for at least 30 days.
- Binding arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that is not resolved informally will be resolved by final and binding arbitration, administered by the Singapore International Arbitration Centre (SIAC) under its rules in force at the time of commencement. The seat of arbitration shall be Singapore. The language of the arbitration shall be English. The tribunal shall consist of one arbitrator.
- Class-action waiver: You and TGC each agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. No arbitrator may consolidate more than one person's claims or preside over any form of class proceeding.
- Exceptions: Either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual-property rights or confidential information. Small-claims court actions for amounts within that court's jurisdictional limit are also permitted.
- Opt-out: You may opt out of this Section 13 by sending a written notice to info@theglobalconservatory.com within 30 days of first accepting these Terms. The notice must include your name, account email, and a clear statement that you wish to opt out.
14. Governing Law
These Terms are governed by the laws of Singapore, without regard to conflict-of-laws principles. Subject to Section 13, the courts of Singapore have exclusive jurisdiction over any matter not subject to arbitration. Nothing in these Terms removes mandatory consumer-protection rights you may have under the law of your habitual residence.
15. Changes to These Terms
We may update these Terms from time to time. The "Effective Date" at the top will be revised when changes are made. Material changes will be communicated by email and a notice on the Services at least 14 days before they take effect. Continued use after the Effective Date constitutes acceptance.
16. Miscellaneous
- Entire agreement: These Terms, together with our Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and TGC regarding the Services.
- Severability: If any provision is held unenforceable, the remaining provisions remain in full force.
- No waiver: Our failure to enforce any provision is not a waiver of that provision.
- Assignment: You may not assign these Terms without our written consent. We may assign in connection with a merger, acquisition, or sale of assets.
- Notices: We may give notice by email or through the Services. You give notice to us at info@theglobalconservatory.com.
- Force majeure: Neither party is liable for delay or failure caused by events beyond reasonable control, including outages of third-party platforms, natural disasters, or acts of authority.
- Independent relationship: Nothing in these Terms creates a partnership, employment, or agency relationship between you and TGC.
